Before January 1, 2005, such fathers had little or no recourse other than to comply with the court order or request a set-aside with little hope of relief. As of January 1, 2005, however, the State Legislature passed AB-252 which gives fathers a two-year window (from January 1, 2005, until Janurary 1, 2007) to challenge paternity through court ordered genetic testing under more liberal requirements. If the test results disprove paternity, the case may be dismissed, though it is questionable whether child support arrears are dischargeable. Bye the way, a false allegation of paternity is abuse; or, if you prefer, domestic violence, it's also child abuse.
